Plaintiffs wanted eggs to be labeled as cage-free, free-range or from caged hens

A lawsuit that sought to require labels on egg cartons concerning the methods of production has been dismissed by a federal appeals court.

The suit, filed by Compassion over Killing, the Animal Legal Defense Fund and six consumers, pushed to have egg cartons to have the following labels on the type of eggs inside the cartons: “free-range eggs,” “cage-free eggs,” and “eggs from caged hens.”

According to Courthouse News, the plaintiffs alleged that eggs from caged hens are nutritionally inferior and carry with them increased risk of Salmonella infections.

The suit, filed against the U.S. Food and Drug Administration, the Federal Trade Commission, Food Safety and Inspection Service, and Agricultural Marketing Service, was initially filed in 2013, with the court ruling in favor of those agencies. The most recent ruling, by the Ninth Circuit federal appeals court, upheld that ruling.
